Characteristics and Achievements
1.The Court is a professional one for the trying of appeals.
The Court is a professional one for the trying of appeals over disputes on public law between the public and government authorities. Therefore, when people ignore administrative punishments on such matters as tax collection, land expropriation, emission of wastewater and exhaust gas, and collection of community development fees or even some issues such as referendums, the Courts handle such cases. The Amadeus oil tanker pollution case, mercury pollution case of Formorsa Plastics, Kaohsiung Rapid Transit passing Apple Building, etc., which have been excitedly discussed on the media were handled by the Court. Thanks to the professional legal knowledge of the judges, these cases were completed satisfactorily. Most of the cases handled by the Court concern tax collection (49.7%), land (11.28%), environmental protection (7.07%) and tariffs (4.54%).
2.Establishment of the One Stop Window service and Measures to Facilitate People and Treat them with Courtesy
To enhance our services to the public, the Court established the one-stop window-Joint Service Center in which such issues as receipt of documents, receipt of complaints, receipt of fees, appeal assistance, copying and review of documents are dealt with. In the meantime, an introduction to the Court and a touch-screen computer inquiry service are available so that people can read on their own or obtain information on session dates and main texts, etc. For appeal assistance, we have selected one section chief and one chief secretary who are familiar with administrative appeal practice and are enthusiastic in replying to questions on law and assisting in the writing of complaints by people. To handle questions on administrative appeal procedures and pleading, open and confidential e-mail accounts were established for people to use on-line. To ensure good service, we do not take breaks at noon and accept complaints in the evening.
3.Aggressive promotion of the administrative appeal system and strengthening the concept of administrative law and order
To help administrative authorities and attorneys understand the new administrative appeal system, further ensure administrative authorities pay attention to people's rights and attorneys understand how to help their clients claim their rights, judges of the Court were warmly invited to explain the new administrative appeal system to each administrative authority and association of attorneys while promoting the concept of administration by law and emphasis on people's rights. Since the establishment of the Court, the President, Court Chief, and judges have been invited respectively by Kaohsiung City Government, Kaohsiung County Government, Tainan County (City) Government, Yunlin County Government and Chiayi County Government as well the Kaohsiung and Taipei Associations of Attorneys to give lectures on Petition Law, the Administrative Appeals Act and Administrative Procedures Act to help civil servants in administrative authorities and attorneys in practice to understand new administrative remedies and relevant administrative regulations This also enhanced the concept of administration by laws of civil servants and assisted attorneys in becoming more familiar with the application of the new system in order to protect the rights of people. Also for law education at schools, the President and Court Chief have been actively giving lectures on law or become instructors of law service associations in colleges for legal consultation.
4.Recruitment of voluntary workers and establishment of waiting rooms for clients, witnesses and appraisers to improve the quality of service
To improve the quality of service, the Court recruited many voluntary judiciary workers to serve the public at the front gate and established waiting rooms for clients. To provide visitors to the Court with a comfortable place to wait, the Court has specially prepared fully planned and relaxing waiting rooms for clients, witnesses and appraisers. The interior facilities are modern and have an electronic number calling system. Water and the latest newspapers and magazines are available with a large plasma TV screen playing short clips on legal subjects for the public.
5.Holding of introductory activities with the public to improve the relationships of the Court with them
The Court holds introductory activities with people, inviting chiefs of "lins" and "lis", mediation committee members, college students, and staff in administrative authorities in the areas of jurisdiction to visit the Court. In addition to helping them understand the functions of the Court, such activities can help interaction between the Court and the people as well as improving understanding of judicial innovations. To encourage people, students and teachers to pay a visit, besides printing practical publicity articles, the Court prepares buses to pick them up. Up to now, the Court has had chiefs of "lins" and "lis", meditation committee members, community groups, teachers and students from schools in the areas of jurisdiction in for visits and discussions. The results are good with positive comments from the public.
6.Publishing compilations of judgments, records of discussions and research theses for public reference
The Court selects judgments of importance and with reference, representational or educational value every six months for public reference. Since the establishment of the Court on July 1, 2000, one issue has been published periodically with positive comments from all fields requesting periodicals. To develop social education, the Court also publishes compilations of the Administrative Appeal Act and relevant regulations, minutes of discussions on tariffs and researches theses on tariff administrative appeals for comprehensive reference.
7. Promoting the computerization of judicial matters
Since the establishment of the Court, we have been working aggressively to promote the computerization of judicial matters to improve efficiency. All Court matters have now been computerized. The written records in the Court have been computerized on the spot. Digital recording equipment is available so that people can request CD' s of the recording. Also in order to help witnesses and appraisers respond to questioning, a tele-interrogation system is available.
8.ISO 9001 Certification; practice of the concepts of justice for the people
To practice the concepts of justice for the people and improve service quality for the public, the Court aggressively introduced an ISO 9001 certification system in May 2004. After the efforts of five months, we passed certification on September 29, 2004 and are proud to be the first administrative court acquiring such a certificate in Taiwan.
